Hi. Thank you for careing about this topic.
I have a big problem for appling changing visa from B2 to H1B. I went
to USA on Feb 2006 and get 6 months staying, so my B2 visa will expire
on Augest,2006. Because I have a good experience in mainframe system,
recently some company contacted me to give me a offer with sponsoring
me a H1B. But you know, Cap of 2007 will be available only after Oct.
2006, there are 2 months between Aug and Oct, How can I maintain my
status between them?... I have thought several ways, but all of them
have some problems:

1) petition for H1B now.
question: if I successed, which status am I between Aug and Oct?
B2/H1B ?
If B2, How can I maintain legal status between Aug
and Oct.
If I can not maintain it, What should I do?

2)go back to my home country and back USA again, get another 6 months
and then petition for H1B.
question: I'm afraid I'll be rejected when I'm entering the entry of
USA.

3)changing my visa from B2 to F1 first, and then changing F1 to H1B.
question: you know, Cap of 2006 have reached on Aug. 2005, it's
seems likely that Cap of 2007 will be reached on Aug.2006. I have not
enough time to change visa twice between now and Aug.

I think you will get better answer in some other newsgroup such as
immigration portal

But I will try to answer....I think you have very little choice. All
you can do is ask your prospective employer to file for your H1. You
leave the country in Aug 2006 when your B1 expires and then apply for
H1 from your country for Oct 2006. Unless someone gives you a better
idea..........
