Post subject: Spherion/Dell NOT paying overtime Archived from groups: austin>jobs, others (more info?)

So I just got off a call with Spherion regarding potential contracts at
Dell. Did you know that Dell recently injected a third party into its
contracting process, such that outside recruiters now work with this
third party, who works with Dell? But that's not the best of it. At
the END of the interview/screening, when discussing rates, I was told
that overtime was expected but that it would contractually be paid at
STRAIGHT TIME, not TIME AND A HALF. So THAT's how Dell is reducing
costs... trying to illegally circumvent overtime laws.
For those out there contracting, I'd recommend staying away from
Spherion (and especially Dell), and TEK Systems (who tried the same
thing with me at Dell). There's bad juju afloat, my friend.

I'm not a lawyer, but if you are paid hourly, then you are due
time and a half for overtime, whether DELL pay that to the
middleman or not, is irrelevant. The company YOU work for
is the one who should have to pay.
See if TWC, or Wages and Hours can help. (You may want to wait
until after the Republicans have lost control of the state.)

Not trying to defend them, but would you have been an employee (W2) or a
contractor (1099) ???
I'm assuming the latter. Unfortunately, contractors are self-employed,
and as such not subject to overtime laws.
If not, there's no legal way around it. As an employee you are entitled
to time and a half past 40 hours per week.
Now you said they *told you* overtime was to be expected. If such an
expectation is not part of the written contract, you would be under no
obligation to follow it. You hit 40 hours, you go home for the rest of
the week. Maybe you can pull a few 14 hour days in a row & have 4 off.
(Though you'd probably spend the first day resting up & de-compressing...)
That one would get interesting if they tried to terminate you on such
grounds, but really nothing can be definitively said without seeing the

Not necessarily, as the status of those who qualify for OT after forty
hours changed two or three years ago. A lot of technical, engineering,
lead and support positions now are classified "professional" and are exempt.

Dell is pitiful windoze box assemble with a reputation of being far
below a reputable employer. Spherion etc. follow in the same path...
